The controversial gun control law commonly known as the ‘NY SAFE Act’ (New York Secure Ammunition and Firearms Enforcement Act of 2013 passed by the New York State Legislature on January 15, 2013, and signed into law by Governor of New York Andrew Cuomo on the same day) may be showing signs of being far more reaching than originally described.
The legislation was allegedly written in response to the Sandy Hook Elementary School shooting in Newtown, Connecticut. Cuomo described the law as the “toughest” gun control law in the United States and went on to say;
“The SAFE Act stops criminals and the dangerously mentally ill from buying a gun by requiring universal background checks on gun purchases, increases penalties for people who use illegal guns, mandates life in prison without parole for anyone who murders a first responder, and imposes the toughest assault weapons ban in the country. For hunters, sportsmen, and law abiding gun owners, this new law preserves and protects your right to buy, sell, keep or use your guns.”
Radio host Tom Bauerle of WBEN (Buffalo, New York) has made the claim that the Department of Homeland Security(DHS) is collaborating with New York State government officials to confiscate guns belonging to people who are deemed, often erroneously, to have a mental condition.
Bauerle explained on his program that several sources inside NY State Govt have told him that “the Dept of Homeland Security played an active role in meeting and collaborating with NY State Officials to develop and implement the confiscation scheme that targeted David Lewis and an as yet unknown number of others,”.
According to Becky Akers who wrote over at the LRC Blog, David Lewis is a librarian who lives in Amherst, New York, and owns several pistols. He once swallowed some anti-anxiety medication — allowing cops to grab his guns pursuant to the SAFE Act’s cruel discrimination against people with “mental-health issues.”
Turns out cops had the wrong “David Lewis.” Alas, the right one won’t fare as well when Barney Fife finds him because at least the wrong one got his guns back — after lots of humiliation and trauma. Wanna bet poor David’s chugging more medication?
“‘I was extremely shocked and saddened and immediately just felt embarrassed knowing that someone had thought negatively of me and wrongly. I had absolutely no idea how this could have happened,’ said Lewis…” He also ”hoped his health record would be confidential. ‘It’s not right. i always thought people could expect more privacy than that,’ said Lewis.”
His lawyer added, “They took his property without compensation, without probable cause, there was no due process. They violated every federal law that you could possibly imagine.” Ah, but that’s what the SAFE Act is for.
Back in March it also emerged that the DHS was working with the Department of Revenue to collect information on gun owners in Missouri.
